Default Best Tequila Pictures Anywhere!

I got an email this morning advertising a New Year's Eve and New Year's Day Celebration at a restaurant in Orange County. They included a very nice picture of Patrida together with a Riedel glass that was amazing - the type of tequila picture I thought only our own Don Ricardo de Hawaii could take.

After looking at his pictures here I think the reason that theirs looks so much like one of his pictures is that it is one of his pictures. Rick hope you got some good royalities from them - at least they know quality pictures when they see them.

The document opens up without the photo in question.

It sucks to be ripped off...

I might have done something wrong uploading the document although I can open it with the picture.

I am hoping Rick wasn't ripped off but got a nice pile of money to buy tequila.

Hmmm, I'll have to check with them. That is my picture but I did not give my permission for its use in advertising I only shared it on their Facebook page. By posting on Facebook I thought I might get some interest from people who might want to use it for marketing but had hoped I would be compensated. Methinks someone owes me some tequila!

I put a nice comment on their facebook announcement for this event regarding my displeasure at having my picture used without permission or cedit so we will see what they do. Some jerk posted this though "Ronnie Robertson: Stop crying Dick"

That Ronnie is truly a JERK. I wonder if he was the one who created the mailer.

I wonder what you can do after "sharing/tagging" the photo on FB... does it mean that you give them implied permission to use it as they chose?

I wouldn't think that every picture ever on facebook could be used for commercial purposes / gains without the owners permission. That would imply to me that any picture I can access on the internet I can use in advertising campaigns, etc. which doesn't seem right.

Maybe this is one of those "lessons learned" times and in the future put a big red stripe across the picture saying something like "Cannot be copied, duplicated or used without owners permission".

I am still hoping you get some tequila out of it.

Makes you want to watermark all of your photos... I find my bottle photos all over the internet, and rarely does anyone ask for permission.

Sorry to hear about that DRdH, hopefully you can get something out of it.

I wonder if you should contact Facebook about this, it may be against their policy and they could do something about it.

Actually Laura has done some research into this as she posts her photos on facebook for clients to view and she does watermark them. Facebook has the rights by their disclaimers to all photos posted on the site but individuals would have to conform to all copyright laws. I say persue this especially if the goof ball that told you to stop crying has anything to do with this restaurant. I have a friend that had a similar issue on a larger scale that made out pretty good with a settlement.
